1. Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and OwnPodAI ("we", "us", "our"). By accessing, downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

We reserve the right to modify these Terms at any time. Continued use of the App after any changes constitutes acceptance of the updated Terms. We will notify users of material changes through the App or our website.

2. Description of Service

OwnPodAI is a mobile application that enables users to run open-source artificial intelligence (AI) language models locally on their Apple devices. The App provides:

• On-device AI inference using locally downloaded models
• Support for multiple open-source AI models in GGUF format
• Integration with Apple Foundation Models framework
• Optional connection to user-hosted local AI servers (e.g., Ollama)
• Voice input and image analysis capabilities processed on-device

3. Privacy & Data Processing

OwnPodAI is designed with privacy as a core principle:

• On-Device Processing: All AI inference occurs locally on your device. No conversation data, prompts, or responses are transmitted to any external server.
• No Data Collection: We do not collect, store, transmit, or process any user data, conversations, personal information, or usage analytics.
• No Accounts: The App does not require user registration, login, or account creation.
• Model Downloads: When downloading AI models, network requests are made to Hugging Face (huggingface.co) to retrieve model files. These downloads are subject to Hugging Face's terms of service and privacy policy.
• Local Server Mode: If you connect to a local server (e.g., Ollama), data is transmitted over your local network only. We have no access to this traffic.

4. Eligibility

You must be at least 13 years of age to use OwnPodAI. If you are under 18, you must have parental or guardian consent. By using the App, you represent and warrant that you meet these requirements.

5. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, for personal, non-commercial purposes, unless otherwise agreed upon in writing.

6. User Responsibilities

You agree to:

• Use the App in compliance with all applicable local, state, national, and international laws and regulations
• Not use the App to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Not use the App to generate content that infringes upon intellectual property rights of third parties
• Not reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except as permitted by applicable law
• Not use the App in any way that could damage, disable, overburden, or impair the App's functionality
• Not redistribute, sublicense, or resell the App or any part thereof
• Take responsibility for all content generated using the App

7. AI-Generated Content Disclaimer

OwnPodAI does not guarantee the accuracy, reliability, completeness, or suitability of any AI-generated content. The AI models used in the App are third-party open-source models, and their outputs are not reviewed, endorsed, or warranted by OwnPodAI.

8. Third-Party Models & Licenses

The App provides access to third-party open-source AI models. Each model is subject to its own license terms:

• Gemma (Google DeepMind): Gemma Terms of Use
• Qwen (Alibaba Cloud): Apache 2.0 License
• Llama (Meta): Llama Community License
• Phi (Microsoft): MIT License
• Mistral (Mistral AI): Apache 2.0 License
• Granite (IBM): Apache 2.0 License
• Bonsai (PrismML): Apache 2.0 License
• LFM (Liquid AI): Liquid AI License
• Cogito (Deep Cogito): Apache 2.0 License

By downloading and using these models through the App, you agree to comply with their respective license terms. OwnPodAI is not responsible for any changes to these third-party licenses.

9. Imported Models

The App allows users to import custom GGUF model files. By importing a model:

• You represent that you have the legal right to use the model
• You acknowledge that imported models are not tested or verified by OwnPodAI
• You accept all risks associated with running imported models
• OwnPodAI is not responsible for any harm, crashes, or unexpected behavior caused by imported models

10. Apple Foundation Model

The App may integrate with Apple's Foundation Models framework. Use of Apple Foundation Models is subject to Apple's terms and conditions. OwnPodAI is not affiliated with, endorsed by, or sponsored by Apple Inc.

11. Intellectual Property

The OwnPodAI name, logo (wireframe cockatoo design), app interface design, and original code are the intellectual property of OwnPodAI. The underlying AI inference engine (llama.cpp) is used under the MIT License. All third-party model names and logos are trademarks of their respective owners.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OWNPODAI AND ITS DEVELOPERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or business opportunities
• Damages arising from AI-generated content
• Damages arising from the use or inability to use the App
• Damages arising from unauthorized access to or alteration of your data
• Any other matter related to the App

In no event shall our total liability exceed the amount you paid for the App in the twelve (12) months preceding the claim.

13. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

14. Indemnification

You agree to indemnify, defend, and hold harmless OwnPodAI and its developers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the App, violation of these Terms, or violation of any rights of a third party.

15. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App ceases immediately. You may terminate your use at any time by deleting the App from your device.

16. Subscription & In-App Purchases

OwnPodAI may offer subscription plans or in-app purchases ("Pro" features). Payment is processed through Apple's App Store. Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date. Refunds are subject to Apple's refund policies. We reserve the right to modify subscription pricing with reasonable notice.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of New South Wales, Australia.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and any applicable third-party model licenses, constitute the entire agreement between you and OwnPodAI regarding use of the App.
